3 VICTORIA 3.1 Guide to the Victorian legislation review schedule [Summarised from VictoriaÕs progress in implementing COAG and related reforms, Interim 1996-97 annual report for the half year to 31 December 1996, March 1997, and information on progress received from VictoriaÕs Competition Policy Unit on 18 September 1998.] Legislative Reviews VictoriaÕs legislation review schedule lists some 430 Acts and regulations for review between 1996-97 and 1999-2000. During 1997-98, Victoria conducted several high profile reviews, including reviews of liquor licensing/retailing, barley marketing (jointly with South Australia) and dental profession regulation. Victoria has removed some legislation from its original program where preliminary review has shown that the legislation contains no restrictions on competition or where that there is no scope for change due to significant costs or where the legislation is repealed or the restriction removed. In July 1996, the Department of Premier and Cabinet released Guidelines for the Review of Legislative Restrictions on Competition, setting out administrative and methodological guidelines to ensure reviews are undertaken in accordance with the NCP principles. The Government has also issued Guidelines for the Application of the Competition Test to New Legislative Proposals (January 1996) to assist agencies comply with legislative review guidelines in respect of proposed 51 Legislation Review Compendium new legislation. Cabinet submissions containing new legislative proposals are required to indicate that the competition test has been applied and justify restrictions on competition. Continuing compliance, including compliance of associated regulations made under Acts, will be reassessed every 10 years. The responsible Minister has a similar role in relation to new regulation. Local Government by-laws are being reviewed under separate processes. [Victoria provided the following classifications and information on legislative reviews]: Items included in timetable Name of legislation: While in most instances entire items of legislation are listed in the timetable, in many cases reviews will focus only on provisions which restrict competition. Such restrictions will be identified as the first stage in a review, in accordance with procedural and technical guidelines. Priority: Reviews are classified as high, medium, or low priority depending on the likely significance of the benefits to the economy from reform of the relevant restriction on competition. The likely magnitude of each review is indicated on an ascending scale as follows: • Simple minor review Ñ cases where there are no significant impediments to removing restrictions on competition, where their removal would be consistent with established government policy and where there are unlikely to be significant public interest issues to be addressed; Complex minor review Ñ cases where the removal of existing legislative restrictions on competition would be technically straightforward, but there are complex public interest issues to be addressed; and Major review Ñ cases where the removal of legislative restrictions on competition would involve complex technical issues and/or where there are complex public interest issues to be addressed. • • 52 3 Victoria In general, reviews rated high or medium priority and classified as major or complex/minor in scale require more extensive public consultation processes, whereas low priority reviews and those not involving complex or contentious public interest issues may be conducted in-house where appropriate. Status: The following key is used to describe the current status of each review: ¥removed: the legislation has been removed from the timetable, for example because no restrictions on competition have been found; the review is currently in progress; the review has reported to the Government.; the Government has announced its position on the review recommendations. ¥started: ¥reviewed: ¥responded: Date set for completion: The table indicates the proposed completion date for each review. Dates are subject to revision in respect of reviews subsequently nominated for national review. Limitations on the coverage of reviews Agreement Acts: broadly provide legislative backing to contractual agreements entered into by the Government with the private sector. Such Acts are common where an exclusive franchise has been granted to extract State owned forest or mineral resources or to conduct a business. They may also include provisions that preclude such rights being granted to other parties. By their nature, these Acts often restrict entry to particular markets for the period of the agreement. As such, they will involve legislative restrictions on competition falling within the requirement for review under the Competition Principles Agreement. To balance the requirement for review against the limitations imposed by existing private rights and obligations, reviews initially identify the scope for change while preserving existing private rights and obligations and, where 53 Legislation Review Compendium there is scope for change, proceed within those parameters. In several cases, preliminary consideration by Victoria has indicated that amendment to agreement Acts would not be possible without exposing the Government to substantial damages for breach of contract. For Agreement Acts nearing their term, consideration can be given to options following the expiry of existing private rights and obligations. Law and order legislation: These forms of legislation proscribe certain activities and create rights and obligations and law enforcement powers of the State through the Courts and the Police Force. The creation of these law enforcement powers does not in itself constitute a restriction on competition, although restriction on who may carry out related administrative functions may do so. For this reason, it is useful to distinguish between powers constituted by the State and operational functions that support them. In practice, operational functions shift between public and private sectors and any legislative restrictions on private sector provision would therefore require review, with particular attention to how differing accountabilities impact on net public benefit. Reviews generally focus on operational elements, such as administrative support and corporate services, information gathering, reporting and inspection. State revenue laws: As with law and order, the power to tax is constituted by the State and, while it may add to costs, is not a restriction on competition and not subject to review. However, certain measures taken to enable tax collection Ñ such as restrictions on the availability of business licences Ñ will require review. In these cases, reviews are limited to the consideration of operations that ensure secure revenue collection. Anti-discrimination legislation: enforces employment on merit consistent with efficient labour market operation.
